Holidaying Republic Day


Today, we are celebrating Republic Day in India. “We” means, my friends are celebrating it. For me, it's nothing more than one more holiday, from one angle. From another view point, I must congratulate all the Indians for this day. This is the day when their country was declared Republican country after it got independence.

Let's celebrate with them as and when you celebrate your neighbours' festival with them, then, the day will come they will congratulate you too when you reach this stage-the stage of republicanism.

January 26, 1950 was the day when India's Constitution, the largest in the world, was issued/ promulgated and its preamble mentions that India is a "secular, socialist, democratic republic". So, this day is auspicious in Indian History after Independence Day.

Though it was a republic day, it did not matter much to me except occasionally wishing people. As I said it is another great day for me in terms of holiday. I slept as usual till 10 o'clock which I do in most of the holidays except rare instances.

In our University, there will be national flag hoisting on two occasions, one on Republic Day and another one on Independence day. Our Vice-Chancellor of University hoists the flag, gives little speeches and at last, Laddu will be distributed to all, to all the students , staffs and teachers present there.

In my first 3 to 4 semester, I also attended that ceremony, listened to Vice Chancellor's speech, saw them singing national anthem, stood with them when they sang national anthem, moved my lips here and there saying "Jana Gana Mana.........hey .......Bharata bhagya vidata......jaya hein etc." I do not know India's National Anthem fully and on all occasions, I stand by them to sing, moving my chin here and there. And in all those time of flag hoisting, when I was there, we ate Laddu.

After attending for few occasions, there used to be a talk in the hostel and guys used to say as a joke, “hey! We should attend tomorrow, we get laddus."

Of course not starved in this earth till date, no one used to go there because of Laddus but the main thing to drive them there was the pride of being Indians, my friends used to go there. I accompanied them to share their feelings as a good neighbourly friends.

Now a day, very few things are good incentives than nice sleep till 10 o'clock. Because the flag hoisting programme will be at 9 o'clock, I miss them regularly now a day even that day comes once in a semester.

I got up today early in the morning, at 10 o'clock. I met Mahesh BABA (His name is Mahesh, hails from Karnataka and because of strong religious devotion in Hinduism; whole world of NALSAR knows him as Baba).

I wished him, I said, "Happy republic Day". He thanked me, "I would say same to you, but I thought it would be inappropriate" said he.

I said, "Yes, it would be."............wait for some months, the day will come............what an optimism I have!!!!! ......I wish it comes true.

Turning to the dreams of Republic Nepal, which I expressed from my very first morning, are the dreams of millions of Nepalese People who have been stricken in poverty and royal oppression. Nepal as a whole should move to the Republicanism.

But what is happening in Terai?

I am from Jhapa, it's a Terrain. Am I Teraibasi? Am I pahade? Am I madhise? Why so much distinction and violence there.

As I read a letter that was posted in United We Blog, I am convinced that the JTMM has been used to create a rift among the people in Nepal so that anti-republic force may win in this revolutionary process. There is no other way than dialogue at this stage and

I have a dream that the dream of Republic will not be sabotaged in pieces demanding "Republic Madhise land", "Republic Pahade Land" and so on….......We must ensure that there will be only one Republic and that too "Republic of United Nepal".

Then see people like Mahesh Baba will say "Happy Republic Day of Nepal".....

For the time being, I am holidaying Republic Day.......Republic Day of India......

Because of my little carelessness, I deleted my earlier blog by mistake yesterday night. I have tried to replace those materials as it was in my back up files in my computer but unfortunately those comments which were very valuable to me could not be retrieved. I would like to sincerely thank from the bottom of my heart to all of you who visited my blog quite frequently and always encouraged me from your comments.
I apologize for being out for quite sometimes and really thank all of you who really cared to visit me and inquired by phones and email what was wrong with my blog. I hope that your patronage and loyalty to my blog will be a continuous process.

NEW NEPAL IS POSSIBLE!!!!

First of all Congratulations everybody!!!! You must be happy today and waiting with a lot of enthusiasm when there will be a morning-The morning of MagheSankranti or the morning of January 15.
First of all, Congratulations to all on occasion of Maghesankranti and if you are from North India Happy Lori and if from south India, Happy Pongal. These all are festivals during these days around this south Asian Sub-continent.
It's already 3 o'clock in the morning according to Nepali Standard and people might be making preparation to get up to cook Khole and put Paral for various domestic animals. After 1 to 2 hours later, in Nepali villages and
Near some rural areas, people start doing their work of another day. Just another day for them.
But, it is not. It is not just another day in Nepal. It is some special day in Nepal. It is our V-day, it is our D-day. Far in Kathmandu, far from most of the rural areas in Nepal, something is going to happen on this 15th January day.
It can be heard that they are changing the face of Nepal from this day, they are going to construct a New Nepal and they have started the foundation of peaceful and prosperous Nepal. Let's hope Our Dreams Come True. Again Congratulations to us.
As I said it is already 3 in the morning and I have not slept yet. I may sleep around 5 and 6 in the morning and by the time I get up, many things might already change. I try to sleep with a desire to see a New Nepal in my dream, with a desire to see a New Nepal by the time I get up at some time in the afternoon.

I hope my dreams come true and my dreams are the dreams of 2.5 million people of this country, Nepal. My dream is the dream of millions of people in Nepal who reside inside or because of various reasons outside Nepal. You may be or may not be surprised but they say that it is the dream of our neighbours as well to see a peaceful and prosperous Nepal.

As I have read in various news sites, I can feel the readiness of stage. The stage is ready. The space is increased in Parliament House to make place available for more than 300 Representatives. They say they are our representatives, from Girija to Prachanda and from Sujata to Anandidevi. They want to be the messenger of New Nepal to change the raggy appearance of Nepal. May God bless them if it exists (?)
Basically, I can see these four agendas are in the pipeline for 15th january's historic day. The old Constitution will be nullified with new interim Constitution, the position of king will be suspended, the House of Representatives of Nepal will be dissolved, and new Interim parliament in Nepal will be formed tomorrow. These are short agendas for tomorrow. There are long and very long plans to set up a just, equitable society, and to reconstruct the state providing equal opportunities to all. This all ultimately should lead to set up a republic Nepal, or if not possible to squeeze the monarchy to be anybody's neighbour in the future. These great tasks are being taken in the future. Let them Unite who are representing us and let us provide our strength in unequivocal words, "We Need peace and Prosperity"

So, rightly has been said by us, New Nepal is possible......

PLACING ADVERTISEMENTS


In Nepali, there is a proverb/saying “Bol ne ko pitho pani bikchha, Nabolne ko Chamal pani Bikdaina”. The literal meaning of this proverb is that if you are expert in speaking, you can sell even flour but if you are bad at speaking, you can not sell even the rice. Naturally, flour is considered to be less quality product as compared to rice when the question of consumption comes. That clearly shows the significance of Advertisement in modern world. People expert in advertisement end up making huge profits in business and in business, advertisements have a great significance.
With the development of business, the cost, time and quantity of advertisements have grown a lot. After the development of Radio, Television, and Newspaper, advertisement has received a great boost. Now, it is the age of digital media and more and more people are using internet. Internet serves a lot of purposes. Medium of various informations and source of vast areas of knowledge are its prime utility. Internet has pushed the advertisement sector also to the new height. If you open any sites, most of the time, you will get small windows automatically opening with full of advertisements. Of Course, You can block them if you are little technology expert but most of us might have been irritated by those pop-ups which just appear on our computer screen whenever we switch on those sites.
Some websites, even if they do not provide pop-up ads, may provide you a lot of links of advertisements. Most of the websites now carry Google advertisements. They are called Google adsense. Almost all major news and commercial sites provide you the Google advertisements and by clicking there, you reach various websites which offer the services similar to the one shown in such links. For example, I have also put Google adsense in my blog which you can see on the left hand side of the Blog. If you click any one of such advertisements, you reach another site where you can get information and advertisements similar to the one links provided.
For some people, Google adsense is very good source of earning as well. When some one adds advertisements in his website, the website owner will be paid depending on the frequency of links that are clicked from his/her website. That effectively means that the owner of the site generally can not determine how much he can earn from such ad sense advertisements. The higher the number of visitors in the websites, the more chances/probability of links being clicked and if higher the click on such links, the more money the website owner can make. The terms of conditions of Google adsense clearly stipulates that the owner can not click such links. Otherwise, any website owner whole day would click on such links in his website and would make easy huge money.
It’s difficult to predict the rate of income that people can make but we can hope that in long term, they are going to benefit from it. There are techniques however, which are called Web Optimization Tools which makes your website more visible to the visitors and there are high chances of being clicked. These Web Optimization tools help any website to put in higher rankings when any search engine is used. That means there is a high chance of seeing your page in first page of Google search results when someone searches something related to your website by using Google search engine if you have made some settings by using optimization techniques. These techniques are more of a kind of brainy exercise rather than any set of formulas and formats. In the age of advertisements, why not we also use these techniques of optimization and earn little so that we can keep our websites running!!!!

SUPREME COURT's POWER IN NEPAL

At that time, I sincerely put some comments in that Article as the questions raised there were quite relevant at this stage but answers given to those questions were not even satisfactory. I appreciated the questions raised by the Authors but dissented in many of his answers. May be the author could not appreciate my views, his subsequent views on the subject matters made little sense to me. I stooped commenting on that Article. There I had offered so many and very long comments and Now, I thought making one Article out of so long comments because the questions raised there are still relevant today. Because of my long travels here and there, I am not able to update the news on the very recent development on the subjects, if any, but without any prejudice to the matters in the court, I beg to offer some views. In substantial part of this article, the comments published in http://www.blog.com.np/ have been compiled but they have been edited so as to make a free flowing Article. The Question Raised and answer given is related to the power of Supreme Court to analyze the Constitutional validity of House Proclamation in Nepal by Nepalese Parliament.

First of all, Supreme Court does not challenge anything. It is some advocates who love to file petition, may be because of their unheard names appear in the newspaper for somedays. Now, after the petition is filed, it becomes the obligation and duty of the Supreme Court to examine the legal validity of any questions which has been raised in the petition. By sending notice to the concerned parties, Supreme Court proceeds to examine the questions that have arisen in the petition and in its process, Supreme Court has rightly sent a notice/show cause notice why and by what process it is right to promulgate Special Resolution of parliament.

Now, first question arises whether Supreme Court (SC) has this power or not. Yes, definitely it has. Because Supreme Court is the independent authority under 1990 Constitution and that status is still intact even after April Revolution. That suggests SC can examine constitutional validity of any legislative process which affects the fundamental rights of the people. It is even because SC is the custodian of people’s rights and various writs can be issued by SC to defend people’s rights. It is the characteristic feature of “Independent Judiciary” to be able to examine the outcomes of legislative process, otherwise, where is the independence? What should be the verdict or outcome of this petition is altogether different questions and on either lines it can be argued but to say SC has no power to enter the writ petition itself is to be ignorant of Judicial process.

One more thing here it is a great time for SC to show that they are still independent. They can give a very landmark judgment at this stage. There are two things that have to be demarcated here.

1. Find out the fundamental things of 1990 Constitution that can not be amended.

2. Find out the policy issues, which can not be challenged in Court of law.

While answering first question, it is a high time to show the judicial activism on the part of the court that these are the features that can not be amended at all under any circumstances like tomorrow, if parliament promulgates or by declaration makes any law saying there is no right to life and liberty and government can take life and liberty of any person in a way land is grabbed from people. This is inherently inconsistent with a basic and standard feature of any constitution. On the same footing, right to equality, no capital punishment, right against slavery can be declared “fundamental features” of any constitution and can be declared null and void from the date of its enactment.

These above mentioned points may not actually arise in the petition but SC can go up to the extent to demarcate the areas which can be amended and which can not be touched. If this line is taken, there is nothing in historic document that can be held unconstitutional.

Now, regarding policy issues, it is the prerogative of any governments to formulate any policy what it likes as promised to the people and it is no business of courts to dictate parliament and government which policy should government formulate. In this basis, most of the things can be shown as the policy of interim government as promised to the people during April Revolution. Unless these policies touch such inalienable rights of people, court can not declare them unconstitutional.

Regarding political issues, there is no clear cut law to say political matters can not be challenged in court or court can not examine political decisions. A lot of political decisions stifle legal issues and resolution which in a way, amends some parts of constitution (Note that Constitution is SUPREME LAW OF THE LAND)can not be merely termed as political issues. These political decisions are bound to be within the realm of legality. Otherwise, in future, in the name of political decisions, “Party dictatorship” arises which again, will be completely unacceptable to us.

Just because all MPs agree to pass it, or it is termed as historic can not make anything perfectly constitutional. Suppose all the MPs of parliament tomorrow declare Mr. X as a terrorist by passing “historic resolution” and decide to kill Mr. X, can we think that they are right? Not at all. At that condition, we have to reach the Supreme Court for nullifying such law and have to ask stay order of Mr. X’s death sentence.

It’s not because how many people pass resolution but because of their power to do so. All the judiciary in the world, which includes Nepal, also has/should have power of judicial Review over the work of administrative and legislative manner. SC must be able to decide the constitutional and legal validity of any such decisions. The Historic document has sought to change a lot of issues which must be tested before the court in light of existing laws and constitution and Supreme Court must have that power.

This post, I am writing after a long time. There are so many things to express in this blog but May be I will be able to include some of the few things I would like to share with you. The last blog I wrote was on November 15th and almost 2 months has elapsed. Being very lethargic and unavailability of suitable environments for writing were the main reasons behind not being able to write and update my Blog. When I leave my Computer in my hostel room, no other outside computers give me that facility and comfort as my computer does. Most of the time the pressure of internship, the unavailability of computer and being very far from the internet web were the main reasons not to be able to update the webpage. But, Finally, I am back in my world. I am back in my hostel room. I am just in front of my Desktop, that black desktop which offers almost everything to my satisfaction.

I have already mentioned that I am transferring my blog from wordpress.com to blogspot.com. There is a small reason behind that. I wish I could reveal that here. But, what people think, if I reveal it here. May be many techsavvy guys can guess why I am moving from wordpress to blogspot but for many, it can be out of imagination. Let it be, whatever the reasons but I will be writing wherever I go and I hope that the patronage or love shown by all the readers will be a continued process.

Today, almost all the days after the class I spent in Internet. I mailed so many people and kept on going through blogs of many people. Mainly, I read blogs but only photos and caption of saynasomething.(http://saynasomething.wordpress.com/)

It was really interesting to see that place from where I have just landed in Hyderabad. While reading her blogs, I felt as if we were just walking in two corners of New Delhi being unknown to each other. While looking at the date of her postings, I could feel that may be we crossed the same road so many times facing each other but being unknown to ourselves. That is the “quality” of being Net friends. I just spent my days commenting here and there.

Now, my usual life has started again in my college. Reading long and long Articles from International Journals and wasting substantial time on projects become the rule of the day. People say this is the age of competition and there are really not much alternatives left to me. Anyways, life goes like this. Not much regret about it.

In this semester, I am thinking to read some books. I have already started about 5 books but neither of them has finished yet. I hope to read some more books in this semester. Making motto is not a wrong idea anyway.

In my final lines, Wish you all the readers very Happy New Year 2007. May this year bring peace and prosperity in our country and wish you all best of luck throughout the years.
